A retainer agreement, along with a retainer amount, is required to start a case.  Fees for criminal cases can be billed either on an hourly basis or as a flat amount.  The actual fees, including the retainer amount, can vary depending upon the severity of the charge, the county of jurisdiction, the anticipated time required as well as other factors.  Clients are required to pay any costs associated with the case.
